Open Burning Permit Rules

(ONLY from January 15 and April 30)

The Applicant accepts the following conditions in obtaining the permit for Open Air Burning from the Westminster Fire Department:

  • Must have a valid permit for the day you burn – No permits will be issued prior to the day you request to burn.
  • NO burning can start prior to 10:00 AM and the fire must be fully extinguished by 4:00 PM the same day.
  • NO burning is allowed within 75 ft from any dwelling or structure.
  • Must provide for control of the fire at all time & sufficient fire suppression resources must be available for the location, size of the fire, and weather conditions.  (Failure to control the fire may result in fines and or fire department fees to put out the fire.)
  • NO fire shall be left unattended at any time.
  • Fires cannot cause a nuisance for others or create significant hazards deemed by the Chief or his designee.
  • Must only burn brush, branches, cane, driftwood, and forest debris that is on land closest to the source of material to be burned.
  • NO burning of Grass, hay, leaves, stumps, tires, or rubbish is allowed.
  • NO burning is allowed for any commercial or institutional purposes.
  • Must use smoke minimizing starting fuels. 
  • The use of gasoline, or white fuel to start or maintain fires is prohibited.
  • Additional regulations related to open burning may be enforced under this permit.
  • This permit does not release the holder of any liability associated with open burning.
  • This permit may be canceled or revoked at any time by the Chief of the Fire Department or his designee.
  • Must have permit available for inspection by any fire department personnel upon request.
